Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of websites, applications, and services operated by Canadian Heart Association ("CHA," "we," "us," or "our"), including canadianheart.com, our course registration flows, and the CHA member portal. By using our Services or registering for a program, you agree to these Terms and to our Privacy Policy.

Education programs

CHA provides resuscitation and related healthcare education. Course descriptions, schedules, instructors, locations, and fees may change. Completion of a CHA program does not guarantee employment, licensure, hospital privileges, or any particular clinical outcome. You are solely responsible for meeting employer, college, regulatory, or certification requirements that apply to your practice.

Our courses are for educational purposes and do not replace independent clinical judgment, institutional protocols, or emergency medical services when a patient requires care.

Eligibility and accounts

You must provide accurate, current information when creating an account or registering for a course. You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly if you suspect unauthorized access.

Registration and payment

Fees are displayed at checkout. By submitting payment, you authorize us (and our payment processor) to charge the amount shown. You represent that you are authorized to use the payment method provided. Tax receipts and registration confirmations may be delivered by email and, where you have opted in, by SMS.

Refunds and course credits

Registration, refund, and course-credit rules are described in our Refund Policy, which is incorporated into these Terms by reference.

SMS program

If you opt in to text messages from CHA, your use of the SMS program is also governed by our SMS Terms of Service and SMS Privacy Notice. Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for help. Consent to receive SMS is not a condition of purchase.

Acceptable use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with the operation of the Services or transmit malware
  • Scrape, copy, or resell course materials except as expressly permitted
  • Misrepresent your identity, qualifications, or affiliation with CHA

Intellectual property

CHA logos, course content, certificates, and website materials are protected by copyright and other intellectual property laws. You receive a limited, non-exclusive license to access materials for your personal educational use in connection with a program you are enrolled in. You may not reproduce or distribute materials for commercial purposes without our written permission.

Disclaimer of warranties

To the fullest extent permitted by applicable law, the Services and all content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent permitted by applicable law, CHA and its directors, officers, employees, instructors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid to CHA for the program giving rise to the claim in the twelve (12) months before the event, except where liability cannot be limited by law.

Indemnity

You agree to indemnify and hold harmless CHA from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Services or violation of these Terms, except to the extent caused by our gross negligence or willful misconduct.

Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the courts located in Ontario for disputes that cannot be resolved informally.

Changes

We may modify these Terms at any time. The "Last updated" date reflects the latest version. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
